Finding somewhere to live in Vienna

A fixed term is a price, not just a date: in the regulated stock a befristet flat must be let 25% below the equivalent indefinite one, and Altbau rents can be calculated before you sign.

The thing people get wrongThe 25% Befristungsabschlag is statutory rather than a bargaining position wherever the Mietrechtsgesetz caps the rent, and it is the single thing most often missing from a Viennese contract. If a fixed-term flat in that regulated stock is offered at the full permitted rent, the discount has been left out, and it is recoverable rather than merely regrettable.

Befristet against unbefristet

Vienna prices the length of the lease as well as the flat. Where the Mietrechtsgesetz caps the rent, a befristet flat must by law be let 25% below the equivalent unbefristet one, and that reduction is mandatory rather than negotiable. Since 1 January 2026 a fixed term on a flat must run for at least five years, or at least three where the landlord was not letting as a business when the term was agreed. Whatever the length, you may leave once the first year has elapsed by giving three months' notice to the last day of a month.

  • A term shorter than the statutory minimum cannot be enforced: the lease then counts as indefinite, which is the tenant's gain.
  • The tenant's exit right after year one runs to the end of a calendar month, so count backwards three months from the date you want out.
  • No fee may be charged for the lease contract itself: the Mietvertragsgebühr was abolished on 11 November 2017.

Which rent rules the flat falls under

Whether the asking rent is legally challengeable depends on the building, not on the landlord: a flat can sit under the full Mietrechtsgesetz, under part of it, or outside it altogether. Establish which before you sign, because it decides whether the Richtwert cap applies at all. For regulated flats the Vienna Richtwert is €6.74 per square metre from 1 April 2026, then adjusted by surcharges and deductions. MieterHilfe, the city's free tenant advice service, publishes a Mietenrechner and an operating-cost calculator and answers on 01/4000-8000, Monday to Friday 09:00 to 17:00.

  • A Lagezuschlag for an above-average location is frequently applied where it should not be.
  • Deductions are frequently omitted: 5 to 15% for a ground-floor street-facing flat, 25% for category B condition, 50% for category C, with further adjustment for fittings, building condition and above-average noise.
  • Vienna runs a free statutory arbitration body, the Schlichtungsstelle für wohnrechtliche Angelegenheiten at MA 50, Muthgasse 62, 1190 Wien, ks@ma50.wien.gv.at, +43 1 4000-74498.
  • The Schlichtungsstelle rules on rent level, operating-cost accounts, usable floor area and heating-cost settlements, and is neither a tenants' nor a landlords' body.

Commission, deposit and Ablöse

Since 1 July 2023 Austria applies the Bestellerprinzip: whoever engaged the agent pays the commission, which in an ordinary letting is the landlord. Where a tenant genuinely did instruct an agent, the statutory cap is one gross monthly rent plus 20% VAT for a fixed term of up to three years, and two gross monthly rents plus 20% VAT only for an indefinite lease or a term longer than three years. The deposit is typically two to three months' rent, must be held so that it bears interest, and may be drawn on only for actual damage you caused — faded paint, scratched floors and drill holes are normal wear and are not deductible. Where a landlord does claim, the charge must be depreciated over the item's remaining life: the Arbeiterkammer's worked example is a ten-year-old sink with a thirty-year life, for which only two-thirds of the replacement cost may be charged.

  • No commission is owed at all if the agent and the landlord or building manager are connected, if the landlord avoided instructing the agent so that you would be the first instructing party, or if the agent advertised the flat with the landlord's consent.
  • The same depreciation logic is the argument against an inflated Ablöse for a kitchen or fitted furniture.
  • The law sets no maximum deposit in months, so treat two to three as convention rather than a ceiling you can cite.

What the rent can do later

Austria's Mietpreisbremse now governs increases to the net Hauptmietzins, and it overrides a contract clause that says otherwise. The rent may be raised at most once a year and not before April 2026, or May 2026 for flats in the full scope of the Mietrechtsgesetz. Where annual inflation runs above 3%, only half the excess may be passed on, so 4.5% inflation permits an increase of 3.75%. For flats in the full scope, the 2025 inflation figure counts as only 1% and the 2026 figure as only 2% when calculating increases in 2026 and 2027.

  • The brake does not cover cooperative flats, single- and two-family houses, or subsidised housing still under housing-promotion law.
  • Ask what the current Betriebskosten advance is and when it was last adjusted; the annual reconciliation is where an old figure becomes a bill.

Where to look, and the queue you cannot join yet

willhaben.at carries the bulk of Viennese rentals, with ImmoScout24.at, derStandard Immobilien and Wohnnet behind it, and a meaningful share of unbefristet flats and flatshares moving through Facebook groups and word of mouth rather than any portal. Municipal and subsidised housing runs through the Wiener Wohn-Ticket, and the gate is time served: you must be at least 18 and have had your Hauptwohnsitz in Vienna continuously for the past two years, with no gap in registration longer than seven days. It is something you become eligible for, not something you arrive with.

  • The Wohn-Ticket also requires Austrian, EU/EEA or Swiss citizenship, recognised refugee status or a Daueraufenthalt EU permit.
  • 2026 income ceilings: €61,280 net a year for one person, €91,320 for two, €103,330 for three, plus €6,730 for each further person.
  • The rent on an allocated flat may not exceed 50% of household income.

In order

  1. Establish which rent regime the building falls under — full Mietrechtsgesetz, partial or none — before you discuss price.
  2. Put the asking rent through the MieterHilfe Mietenrechner, or ring 01/4000-8000, while you can still walk away.
  3. If the lease is befristet, check the term meets the statutory minimum — five years, or three from a landlord not letting as a business — and, in regulated stock, that the 25% reduction has been applied.
  4. Ask who instructed the agent, and pay no commission if the answer is the landlord.
  5. Refuse any charge for drawing up the lease contract.
  6. Agree the deposit in writing and keep the transfer receipt.
  7. Do the handover with a written protocol and photographs of every mark, appliance and meter.
  8. Note the meter readings on your move-in day for the Wien Energie registration.
  9. Register at a Meldeservice within three days of moving in.
  10. If the rent or the operating-cost account looks wrong, take it to the Schlichtungsstelle at MA 50, which costs nothing.
